Terms of Service

1. Acceptance of Terms
By creating an account, accessing, or using MyHandler.ai ("MyHandler", "the Service"), you agree to be bound by these Terms of Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
If you do not agree to these Terms, do not create an account or use the Service.
2. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to use MyHandler. By creating an account, you represent that you meet this requirement and that the information you provide during registration is accurate and complete.
3. What MyHandler Does
MyHandler.ai is an AI-powered gatekeeper operated by Tery Emilson ("we", "us", "our"). It monitors your connected communication channels (email, WhatsApp, Slack, and others), classifies incoming messages by importance, drafts responses in your voice, and — with your explicit permission — sends those responses on your behalf.
MyHandler is designed to reduce information overload by learning your priorities, relationships, and communication patterns over time.
4. How Your Handler Works
MyHandler operates in Supervised mode:
Supervised Mode
Your Handler classifies incoming messages, drafts replies in your voice, and suggests actions — but always requires your approval before sending anything. You are responsible for reviewing all drafts before approving them.
Your Handler never sends anything without your explicit approval. You retain full control over every communication at all times.
5. Account Responsibilities
You are responsible for:
- Keeping your login credentials confidential and not sharing your account with others.
- All activity that occurs under your account, including actions taken by the Handler with your approval.
- Notifying us promptly at legal@myhandler.ai if you suspect unauthorized access to your account.
- Ensuring that the email addresses and channel connections you configure are accounts you are authorized to use.
6. AI Accuracy Disclaimer
MyHandler uses artificial intelligence to classify messages, generate drafts, and make recommendations. While we strive for high accuracy, AI may occasionally:
- Misclassify a message's importance level
- Draft a reply that doesn't accurately reflect your intent
- Fail to identify an urgent or time-sensitive message
- Incorrectly assess a sender's relationship or priority
You retain final authority over all communications. MyHandler is a tool that assists your decision-making — it does not replace your judgment.
Important: MyHandler is not a real-time communication tool. Critical or emergency communications should not rely on Handler review timelines. If a message requires immediate action, handle it directly through your email or messaging client.
7. Data Ownership and License Grant
You own your data. We do not sell, rent, or share your personal data with third parties for their own purposes.
By using the Service, you grant MyHandler a worldwide, non-exclusive, royalty-free license to process, store, encrypt, transmit, and display your content solely to provide and improve the Service. This license terminates when you delete your account.
When you delete your account, we perform a complete and permanent data wipe — all messages, contacts, memories, calibration history, AI-generated content, and analytics are deleted. Only an anonymized audit log entry recording that a deletion occurred is retained.
8. Intellectual Property
MyHandler and its licensors retain all rights, title, and interest in the Service, including all software, algorithms, AI models, designs, trademarks, and documentation. Nothing in these Terms grants you any right to use our trademarks, logos, or branding without prior written consent.
AI-generated drafts and classifications produced by the Service are created on your behalf. You may use, edit, and send them freely. We claim no ownership over content generated for you.
9. What We Access
To deliver the Service, MyHandler accesses:
- Message content — stored encrypted (AES-256-GCM) for your inbox, AI classification, and draft generation. No human ever accesses your messages.
- Message headers & metadata — sender, recipient, subject, timestamps.
- Calendar events — event titles, times, attendees, and location when you connect Microsoft or Google Calendar via OAuth.
- Channel webhooks — incoming messages from connected channels (Slack, WhatsApp, Discord, etc.).
We access only what is necessary to operate the Service. You can disconnect any channel at any time through your Settings page.
10. AI Training & Third-Party Providers
We do NOT train AI models on your data.
We use the following AI providers to process your data:
Groq — Classification & Draft Generation (Default)
Groq operates under Zero Data Retention (ZDR), which we enforce on every API call via a custom header. Your data is processed ephemerally and discarded immediately after inference — it is never stored on Groq's servers, never used for training, and never shared with third parties.
Anthropic Claude — Classification & Draft Generation (Optional)
Anthropic may be used as an alternative AI provider for classification and draft generation. When active, it receives the same data as Groq (message content and context). Anthropic does not use API data to train models. Anthropic retains API inputs for up to 30 days for trust and safety purposes.
OpenAI — Vector Embeddings Only
OpenAI receives only short AI-generated message summaries (not full message content) for converting into vector embeddings used in semantic search. OpenAI does not use API data to train or improve their models. OpenAI may retain API inputs for up to 30 days for abuse monitoring purposes, after which they are permanently deleted.
Across all providers, your data:
- Is never used to train, fine-tune, or improve AI models
- Is never shared with other users or third parties
Additional third-party services (Twilio, ElevenLabs, Firebase, Stripe, and others) are used for specific features. See our Privacy Policy for the complete list of sub-processors and what data each receives.
11. Backup Responsibility
MyHandler is not an email client, storage service, or backup solution. While we store message content encrypted for your inbox and AI processing, we are not a primary message archive.
You are responsible for maintaining your own backups of important communications. MyHandler does not guarantee the availability or recoverability of any message content.
12. Prohibited Use
You agree not to use MyHandler to:
- Send spam, unsolicited commercial messages, or bulk automated communications
- Reverse engineer, decompile, or disassemble any part of the Service
- Scrape, crawl, or automate access to the Service beyond normal use
- Violate any applicable laws, regulations, or third-party rights
- Attempt to bypass security measures, rate limits, or access controls
- Use the Service for harassment, fraud, or any illegal purpose
- Impersonate another person or misrepresent your identity through the Service
We reserve the right to suspend or terminate accounts that violate these terms.
13. Service Availability
We strive to keep MyHandler available 24/7, but we do not guarantee uninterrupted service. Planned maintenance windows will be communicated in advance whenever possible.
- Free tier — best-effort availability, no SLA.
- Paid tiers — prioritized infrastructure and support.
14. Payment & Refunds
Paid subscriptions (Personal, Business, Executive) are billed through Stripe on a recurring basis. By subscribing to a paid tier, you authorize recurring charges to your payment method.
- Refunds — we offer a 30-day refund policy for new subscriptions. Contact support within 30 days of your first payment for a full refund.
- Tier changes — upgrades are effective immediately with prorated billing. Downgrades take effect at the next billing cycle.
- Cancellation — you can cancel at any time. Your subscription remains active until the end of the current billing period.
15. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or secure, or that AI classifications, drafts, or recommendations will be accurate or complete. You use the Service at your own risk.
16. Limitation of Liability
To the maximum extent permitted by law, MyHandler.ai and its operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising from your use of the Service.
Our total aggregate liability shall not exceed the total fees you paid to us in the six (6) months preceding the event giving rise to the claim. For free tier users, our maximum liability is $0.
17. Indemnification
You agree to indemnify, defend, and hold harmless MyHandler.ai, its operator, and its affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) content you submit through the Service.
18. Account Termination
By you: You can delete your account at any time from your Settings page. Account deletion is immediate and permanent — all your data is wiped.
By us: We may terminate or suspend your account if you violate these Terms of Service. For violations, we may terminate immediately with notice. For no-cause termination, we will provide at least 30 days advance notice and a prorated refund of any prepaid fees.
19. Dispute Resolution
If a dispute arises under these Terms, you agree to first attempt to resolve it informally by contacting us at legal@myhandler.ai. We will work in good faith to resolve the matter within 30 days.
If informal resolution fails, the dispute shall be resolved by binding arbitration administered under the rules of the ADR Institute of Canada. The arbitration will be conducted in Ontario, Canada, in English. The arbitrator's decision will be final and binding.
Class Action Waiver: You agree to resolve disputes with us on an individual basis only. You waive any right to participate in a class action, collective action, or representative proceeding.
Nothing in this section prevents either party from seeking injunctive or equitable relief in a court of competent jurisdiction for matters involving intellectual property or unauthorized access.
20. Changes to Terms
We may update these Terms from time to time. When we make significant changes, we will notify you at least 30 days in advance via email and/or an in-app notification. Continued use of MyHandler after the effective date constitutes acceptance of the updated Terms.
21. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any legal proceedings not subject to the arbitration clause above shall be brought in the courts of Ontario, Canada.
22. Force Majeure
We shall not be liable for any failure or delay in performing our obligations under these Terms due to events beyond our reasonable control, including but not limited to natural disasters, pandemics, government actions, internet or infrastructure outages, third-party service failures, cyberattacks, or acts of war.
23. General Provisions
Severability: If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
Entire Agreement: These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and MyHandler.ai regarding the Service and supersede all prior agreements.
No Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
Assignment: You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
